DUI Charges and Infractions

In Illinois, prosecutors are not necessarily required to prove your blood alcohol level exceeded 0.08 and may not need to provide evidence of bad driving. All charges require proof that you were driving or in actual physical control of your vehicle.

DUI Penalties

A first-time DUI will usually be a Class A misdemeanor charge, with the possibility of a year in jail or supervision, a conditional discharge, or probation. A second offense brings stiffer penalties. A third offense may be charged as a felony aggravated DUI.
