Cook County Jail Detainees Sought Release Amid COVID-19 Outbreak
At the height of the COVID-19 pandemic, hundreds of Cook County Jail detainees petitioned for release while awaiting trial, as the facility saw a growing number of confirmed coronavirus cases among its population. Judges were left weighing serious health and safety concerns for detainees against public safety considerations, in cases ranging from low-level offenses to more serious charges.
Attorney Shay Allen represented a client in this situation — a 20-year-old man with chronic asthma and emphysema who was facing felony charges. Allen argued that jail conditions made social distancing difficult and raised real health risks for his client, while also representing that his client wasn’t a broader danger to the community. The court ultimately agreed to reduce the client’s bond from no-bond status to $7,500.
The case reflects the difficult balancing act courts faced during the pandemic — weighing public health emergencies against public safety and the presumption of pretrial release.
